Art Licensing Terms & Conditions Information

The Design Table is our Art Licensing program and the following information is an excerpt from our contract. Full terms and conditions as well as specific commissions and opportunities are presented to artists upon their work being selected and their successful set up in our system. 

By submitting your artwork to our Art Licensing Program, you are agreeing to the following terms and conditions:

  1. Eligibility: You must be at least 18 years of age to submit your artwork.

  2. Commissions: We offer commission rates between 6% and 10% on the sale of products featuring your designs. As a featured artist, you have the opportunity to earn more through our affiliate program.

  3. Copyright and Intellectual Property: You maintain the copyright and intellectual property rights to your artwork. By submitting your designs, you grant us an exclusive license to produce and sell products featuring your designs and derivatives thereof.

  4. Exclusivity Period: We request that you refrain from selling or distributing the artwork submitted to us for 60 days post-submission deadline while we make a decision. If your work isn't selected, you can choose to sell it at will or allow us to keep it in consideration for future releases, which means you cannot sell it elsewhere during this period.

  5. No Copyright Infringement: We do not accept or release products that are at risk of copyright infringement.

  6. Promotion: You grant us the right to use your name, identifying information, and image for the purposes of promoting your design both during and after the selection process. Nothing in these terms and conditions obligates us to promote or sell your design or matching items, even if the design is selected.

  7. Assignment of Rights: If your design is selected, you irrevocably assign us the exclusive right to use your design and any matching items provided by you.

  8. Usage: If your design is selected, we reserve the right to use your design and your name, including but not limited to reproducing the design on products, selling products bearing the design or derivatives thereof, making derivative works of the design, and promoting our brand. You agree not to reproduce, sell, or distribute the work or derivatives thereof in any manner or allow others to do so.

  9. Acceptance or Rejection of Offer: You will always have the option to accept or reject our offer to produce and distribute your design.

  10. Sales Commission: As an artist in our Art Licensing Program, you will be paid a commission on the Net Sales of any products sold by us that wholly incorporate your selected design or its matching items ("Commissionable Items") at a rate between 6% and 10% (the "Sales Commission"). Commissionable Items include elements such as patterns, shapes, or other changes to basic form factors, such as folded cards. Commissionable Items expressly exclude higher quality paper, frames, shipping, personalization, addressing services, and additional custom design services.

"Net Sales" is defined as the retail price received by us from our customer (i.e., the price charged after any promotional discounts, shipping, and taxes) for the sale of Commissionable Items, excluding chargebacks, and returned or defective products. We may offer any products incorporating the design or matching items at any price, for any amount of time in any market, in our sole discretion.
Sales Commissions shall be paid to you within 90 days from the end of each calendar quarter in which they were earned. Calculation of Sales Commissions shall be in our reasonable discretion and shall not be subject to audit or other verification by you. If we believe that you have breached any provision of these Terms and Conditions, then we may cancel or suspend any payments of Sales Commissions to you without prejudice to any other rights we may have against you.
You alone shall be responsible for the payment of any tax that arises as a result of receiving payment from us, as we will not withhold any taxes from the Sales Commissions paid to you.
If your design is selected, we will inform you within 60 days after the submission deadline. After being notified, you are required to provide high-resolution artwork of the selected design and any other requirements, including any applicable matching items, within 14 days. If, after providing you with written notice to produce high-resolution artwork, we do not receive the required artwork within 14 days, then we reserve the right to withdraw your selection and refuse payment for the use of the design and matching items.
